Maker Works SOP Terms of Use
6/10/2020 version 1.2
We’d like you to be able to study our SOPs and related materials when you’re not at Maker Works so that you can use our tools as safely and efficiently as possible when you’re here.
These Terms of Use describe what you can and can’t do with our SOPs and accompanying materials (including videos), as well as provide for a release of liability, assumption of risk, indemnification, and other important issues. It is necessary for you to agree to these terms in order to download, read, and use our SOPs and other materials. (Members may always read printed SOPs at Maker Works.)
Why Terms of Use? Mostly liability--for example, someone uses our SOPs elsewhere and gets hurt, then decides it’s our fault. We do want to find a way for makerspaces to share and improve SOPs and are working on that, but for right now we have to have the following terms.
Awesome. You agree to continue to be as awesome as possible.
Downloading. You may download specific Maker Works SOPs and related materials for your personal use on as many devices as you like.
Printing. You may print one copy of each downloaded Maker Works SOP for your personal use only.
Availability. Maker Works may limit SOP and other material downloads as it wishes--for example, to members signed up for or having taken specific classes, or to specific membership categories. Not all SOPs or materials may be available. Any availability we make of our SOPs and related materials is in addition to the benefits of regular Maker Works membership, and may be withdrawn or modified as we wish at any time.
Sharing, Not. Even though “sharing is caring”, in this case you agree to not share our SOPs or other materials in any form--electronic, printed, telepathic, interpretive dance, etc.--with anyone, unless we ourselves have made them publicly available. You also agree not to share links or other methods that would allow someone to download our SOPs or materials.
Modifying. We encourage you to make notes on your personal copy of SOPs, but such modifications should not be shared with other members. (We of course welcome suggestions for improvements to the SOPs--please share with us so we can include improvements in the official versions of the SOPs.)
Release. You release and discharge Maker Works, and its owners, managers, employees, agents, bailors, contractors and instructors (collectively “Maker Works Representatives”), from any and all liabilities, claims, damages and causes of action whatsoever arising out of any damage, loss or injury that occurs as a result of using Maker Works SOPs and related materials, whether such damage, loss or injury results from the negligence of Maker Works or the Maker Works Representatives, or from any other cause whatsoever.
Assumption of Risk. You agree that our SOPs and related materials describe how we want people to operate our tools, within our makerspace, and that we don’t claim they are applicable to any other situation. If you use the SOPs and materials elsewhere, directly or indirectly, you accept and assume any and all risks and dangers of bodily injury, permanent disability, death and/or property damage, even if caused in whole, or in part, by the negligence of Maker Works or the Maker Works Representatives, that may occur as a consequence of such use.
Indemnification. You agree to indemnify and hold harmless Maker Works and the Maker Works Representatives from any and all liabilities, claims, damages, losses and expenses, including attorneys' fees, which Maker Works or any Maker Works Representatives incur as a result of any claim of bodily injury, death or property damage arising from your use, directly or indirectly, of Maker Works SOPs and related materials.
Changes to SOPs. You agree that we are continually improving our SOPs and related materials, and that while we do our best to keep the SOPs in our shop updated, we have no obligation to keep your individual copy up to date, nor an obligation to continue to make SOPs available. You agree that the printed SOPs at Maker Works are the SOPs to be used in operating equipment at Maker Works.
Nostromo. You agree that the crew of the Nostromo was, at the very least, negligent in their isolation protocols when Kane was allowed to mingle freely after being exposed to the facehugger alien. You agree to exercise more caution, or to give a plausible and satisfactory explanation for taking such risky action in a clear monologue, should you find yourself in this situation in the future.
Jurisdiction and Interpretation. You agree that exclusive jurisdiction and venue for any lawsuit arising out of this Agreement shall be the state courts located in Washtenaw County, Michigan. To the extent that any part of this Agreement is found to be invalid, void or illegal under applicable law, then any such part shall be inapplicable, and the remainder of this Agreement shall continue in full force and effect.
Minor Children. You agree to reaffirm the provisions of this agreement, including but not limited to the provisions relating to releases, assumption of risks, indemnifications, and Nostromo, on behalf of your minor children, and agree that the terms and provisions of this Agreement shall be binding upon your minor children.
Minor Miner Children. If you have minor children who are miners, but you only are concerned a little, you may feel you have a minor minor miner problem, but in fact it is a major minor miner problem. Please seek help.
Binding Nature. This Agreement shall be binding upon your personal representatives and heirs.
Survival. The terms and provisions set forth in this Agreement are independent of your membership or any other relationship at Maker Works and shall survive and continue beyond the termination of any relationship.
